Scam Scanner — iOS Application

1. Agreement to Terms

1.1 These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you” or the “User”) and Reuben Schultz trading as RS Digital (ABN: 99 557 604 248), a sole trader operating from South Australia (“we”, “us”, “our”, or “RS Digital”), governing your access to and use of the Scam Scanner mobile application (“App”) available on the Apple App Store.

1.2 By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy (available at https://tryscamscanner.com/privacy). If you do not agree to these Terms in their entirety, you must immediately cease all use of the App and delete it from your device.

1.3 We reserve the right to amend, modify, or update these Terms at any time by posting the revised version within the App or at https://tryscamscanner.com/terms. Your continued use of the App after any such changes constitutes your acceptance of the revised Terms. We will endeavour to provide reasonable notice of material changes, including via in-app notification where practicable.

1.4 These Terms are governed by and construed in accordance with the laws of the State of South Australia and the Commonwealth of Australia. You irrevocably submit to the non-exclusive jurisdiction of the courts of South Australia and any courts of appeal therefrom.

2. Description of Service

2.1 Scam Scanner is an AI-powered scam detection and analysis tool that enables Users to submit content — including text messages, emails, URLs, screenshots, QR codes, charity names, business names, and other materials — for analysis. The App provides:

  1. A trust score on a scale of 0 to 100;
  2. A verdict classification (such as “legit”, “suspicious”, “exercise caution”, “likely scam”, or “scam”);
  3. Identified red flags and risk categories;
  4. Actionable advice and, where applicable, links to relevant Australian reporting authorities including Scamwatch (scamwatch.gov.au) and ReportCyber (cyber.gov.au); and
  5. Verification against publicly available government registries, including the Australian Charities and Not-for-profits Commission (ACNC) and the Australian Business Register (ABN Lookup).

2.2 The App operates on a freemium model. Free-tier Users are entitled to three (3) scans per calendar day (resetting at midnight ACST/ACDT). Premium subscribers (“Scam Scanner Pro”) receive unlimited scans, subject to fair use and technical rate limits.

2.3 The App is designed with a primary focus on the Australian market and references Australian regulatory bodies, registries, and reporting mechanisms. While the App may be downloaded and used in other jurisdictions, its analysis, registry lookups, and reporting links are optimised for Australian Users.

3. AI-Generated Content — Disclaimer

3.1 IMPORTANT: All analysis, trust scores, verdicts, red flags, and advice provided by the App are generated by artificial intelligence (specifically, third-party large language models) and are provided for general informational purposes only. The App's outputs do not constitute and must not be relied upon as:

  1. Legal advice or a legal opinion;
  2. Financial advice, credit advice, or investment advice within the meaning of the Corporations Act 2001 (Cth) or the National Consumer Credit Protection Act 2009 (Cth);
  3. Professional advice of any kind;
  4. A guarantee, warranty, or assurance as to the legitimacy or illegitimacy of any person, entity, communication, transaction, charity, or business; or
  5. A substitute for independent verification with official sources, law enforcement, or qualified professionals.

3.2 AI-generated analysis may be inaccurate, incomplete, outdated, or incorrect. The App may produce false positives (classifying legitimate content as suspicious) or false negatives (failing to identify genuine scams). You acknowledge and accept that no automated scam detection system is infallible.

3.3 You must always exercise your own independent judgement and verify any information provided by the App with official sources before making decisions, including but not limited to decisions involving financial transactions, charitable donations, sharing personal information, or engaging with unfamiliar entities.

3.4 The following disclaimer is displayed on every scan result within the App and forms part of these Terms:

“This analysis is AI-generated for informational purposes only. Always verify with official sources before making decisions.”

4. Eligibility and User Accounts

4.1 The App is rated 4+ on the Apple App Store and is available for use by persons of all ages. However, if you are under the age of 18, you represent that you have obtained the consent of a parent or legal guardian to use the App and that your parent or legal guardian has read and agreed to these Terms on your behalf.

4.2 You may use the App as a guest without creating an account, subject to free-tier scan limits. To access certain features or purchase a subscription, you may register an account using:

  1. Email and password (stored locally in encrypted iOS Keychain);
  2. Google OAuth 2.0 (Sign in with Google); or
  3. Apple Sign In.

4.3 You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@tryscamscanner.com if you become aware of any unauthorised use of your account.

4.4 We reserve the right to suspend or terminate your account at our sole discretion, including where we reasonably believe you have breached these Terms.

5. Acceptable Use

5.1 You agree to use the App only for its intended purpose of analysing content for potential scam indicators. You must not:

  1. Use the App to harass, defame, or harm any person or entity;
  2. Submit content that is unlawful, obscene, threatening, or that infringes the intellectual property or privacy rights of any third party;
  3. Attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code of the App;
  4. Attempt to circumvent or manipulate the App's scan limits, rate limits, authentication, or security measures;
  5. Use the App to make false or vexatious reports about legitimate businesses or individuals;
  6. Use automated scripts, bots, or other programmatic means to interact with the App;
  7. Resell, sublicense, or commercially exploit the App or its outputs without our prior written consent; or
  8. Use the App in any manner that could damage, disable, overburden, or impair our servers or infrastructure.

5.2 We reserve the right to investigate and take appropriate action, including suspension or termination of access, in respect of any breach or suspected breach of this clause.

6. Intellectual Property

6.1 All intellectual property rights in the App, including but not limited to its source code, design, user interface, branding, logos, and documentation, are and remain the exclusive property of RS Digital or its licensors.

6.2 We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App on your personal iOS device in accordance with these Terms and the Apple Licensed Application End User License Agreement (“EULA”).

6.3 The AI-generated analysis outputs provided to you through the App are provided for your personal use. You may share individual scan results for personal, non-commercial purposes (such as warning family members about a scam). You must not, however, systematically reproduce, redistribute, or commercially exploit the App's outputs.

6.4 “Scam Scanner”, the Scam Scanner logo, and “RS Digital” are trademarks of RS Digital. Nothing in these Terms grants you any right to use our trademarks without prior written permission.

6.5 References within the App to third-party organisations, government agencies (including Scamwatch, ACCC, ACNC, and ReportCyber), and their respective names and logos are used solely for informational and referral purposes and remain the property of their respective owners.

7. In-App Purchases and Subscriptions

7.1 Subscriptions (Auto-Renewing)

The App offers the following auto-renewing subscription plans:

7.2 Subscriptions are billed in advance on a recurring basis (monthly or yearly, as applicable). Payment is charged to your Apple ID account at confirmation of purchase.

7.3 Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period. Renewal is charged within 24 hours prior to the end of the current period at the then-current subscription rate.

7.4 You may manage your subscription and turn off auto-renewal at any time through your iOS device Settings > Apple ID > Subscriptions. Cancellation will take effect at the end of the current billing period; you will continue to have access to Pro features until that date.

7.5 Refunds for subscriptions are handled exclusively by Apple in accordance with Apple's refund policies. RS Digital does not process subscription refunds directly.

7.6 Tips (Consumable, One-Time Purchases)

The App offers optional one-time tip purchases to support ongoing development:

7.7 Tips are consumable in-app purchases and are non-refundable. Tips do not unlock any additional features or functionality and are voluntary contributions only.

7.8 All prices are in Australian Dollars (AUD) and are inclusive of GST where applicable. Apple may convert prices into your local currency if you are purchasing from outside Australia.

8. Privacy and Data

8.1 Your use of the App is also governed by our Privacy Policy, available at https://tryscamscanner.com/privacy, which describes in detail the personal information we collect, how we collect and use it, who we share it with, and your rights in relation to that information. The Privacy Policy forms part of these Terms.

8.2 By using the App, you consent to the collection, use, disclosure, and processing of your information as described in the Privacy Policy, including the transmission of extracted text content (not raw images) to third-party service providers for the purpose of AI-powered scam analysis.

8.3 Images captured via the camera or selected from your photo library are processed entirely on your device using Apple's Vision framework for optical character recognition (OCR). Raw image data is never transmitted to any external server.

8.4 Where you have enabled the “Strip Personal Info” setting, the App will remove identifiable phone numbers and email addresses from text prior to transmission to any external service. This feature is optional and not enabled by default.

8.5 Extracted text and related data may be transmitted to servers located outside of Australia, including in the United States of America. By using the App, you acknowledge and consent to this cross-border transfer of data, which is carried out using HTTPS encryption.

9. Third-Party Services

9.1 The App utilises the following third-party services to provide its functionality:

  1. xAI (Grok API) — for AI-powered scam analysis, accessed via our secure proxy server;
  2. Brave Search API — for web-based entity and scam verification;
  3. Australian Charities and Not-for-profits Commission (ACNC) — for charity registration verification;
  4. Australian Business Register (ABN Lookup) — for business registration verification;
  5. Google OAuth 2.0 — for optional user authentication;
  6. Apple Sign In — for optional user authentication; and
  7. Apple StoreKit 2 — for subscription and purchase processing.

9.2 These third-party services are governed by their own terms of service and privacy policies, which we encourage you to review. We do not control and are not responsible for the practices, content, or availability of any third-party service.

9.3 We make no representations or warranties regarding the accuracy, completeness, or reliability of data obtained from third-party registries (including ACNC and ABN Lookup) or third-party search results. Registry data may be delayed, incomplete, or inaccurate.

10. Service Availability

10.1 We will use reasonable endeavours to maintain the availability of the App and its backend services. However, we do not guarantee uninterrupted, timely, secure, or error-free operation of the App.

10.2 The App depends on third-party services (including but not limited to xAI, Brave Search, ACNC, and ABN Lookup) that are outside our control. The unavailability or degradation of any such third-party service may affect the App's functionality, and we shall have no liability in respect of any such disruption.

10.3 We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice, without liability to you.

10.4 Scheduled or unscheduled maintenance may be performed from time to time, during which the App or certain features may be temporarily unavailable.

11. Disclaimer of Warranties

11.1 To the maximum extent permitted by law, the App is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

11.2 Without limiting the foregoing, RS Digital does not warrant or represent that:

  1. The App's scam analysis, trust scores, verdicts, or advice will be accurate, complete, reliable, current, or error-free;
  2. The App will detect all scams or correctly identify all legitimate communications, entities, or transactions;
  3. The App will be uninterrupted, secure, or free from bugs, viruses, or other harmful components;
  4. Third-party registry data (including ACNC and ABN Lookup results) will be accurate, current, or complete; or
  5. The App's outputs will be suitable for any particular purpose or decision.

11.3 Nothing in these Terms is intended to exclude, restrict, or modify any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted, or modified by agreement. To the extent that any such guarantee applies and cannot be excluded, our liability is limited (at our option) to supplying the services again or paying the cost of having the services supplied again.

12. Limitation of Liability

12.1 To the maximum extent permitted by law (and subject to clause 11.3), RS Digital, its contractors, and affiliates shall not be liable for any:

  1. Indirect, incidental, special, consequential, punitive, or exemplary damages;
  2. Loss of profits, revenue, data, goodwill, or anticipated savings;
  3. Damages arising from reliance on the App's AI-generated analysis, trust scores, verdicts, or advice;
  4. Damages arising from the App incorrectly classifying content as legitimate (false negative) or as a scam (false positive);
  5. Damages arising from any interruption, suspension, or discontinuation of the App or any third-party service upon which the App relies; or
  6. Damages arising from unauthorised access to or alteration of your data or transmissions,

however caused and regardless of the theory of liability (whether in contract, tort including negligence, statute, or otherwise), even if RS Digital has been advised of the possibility of such damages.

12.2 To the maximum extent permitted by law, our total aggregate liability to you for all claims arising out of or in connection with these Terms or your use of the App shall not exceed the greater of: (a) the total amount you have paid to RS Digital for the App in the twelve (12) months immediately preceding the event giving rise to the claim; or (b) fifty Australian Dollars (AUD $50.00).

12.3 You acknowledge that the limitations and exclusions in this clause are reasonable having regard to the nature of the App (an AI-powered informational tool), the price at which it is offered, and the disclaimers set out in clause 3.

13. Indemnification

13.1 You agree to indemnify, defend, and hold harmless RS Digital, its contractors, and affiliates from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  1. Your use of or inability to use the App;
  2. Your breach of these Terms;
  3. Any content or data you submit to the App;
  4. Your reliance on the App's analysis or outputs in making any decision;
  5. Any claim by a third party that content you submitted infringes their rights; or
  6. Your violation of any applicable law, regulation, or the rights of any third party.

14. Termination

14.1 You may terminate your use of the App at any time by deleting the App from your device and, if applicable, deleting your account via Settings within the App.

14.2 We may suspend or terminate your access to the App immediately and without notice if we reasonably believe you have breached these Terms or if continued provision of the App to you would pose a legal, security, or reputational risk.

14.3 Upon termination:

  1. Your licence to use the App shall immediately cease;
  2. All locally stored data (including scan history and account credentials) will be deleted upon App uninstallation or manual deletion through the App's settings;
  3. Any active subscription will continue until the end of its current billing period unless separately cancelled through iOS Settings; and
  4. Clauses that by their nature should survive termination (including clauses 3, 6, 11, 12, 13, and 17) shall survive.

15. Dispute Resolution

15.1 If a dispute arises in connection with these Terms or the App, the parties agree to first attempt to resolve the dispute through good faith negotiation by providing written notice of the dispute to the other party.

15.2 If the dispute is not resolved within thirty (30) days of written notice, either party may refer the dispute to mediation administered by the Resolution Institute (or its successor body) in Adelaide, South Australia, in accordance with the Resolution Institute's mediation rules.

15.3 If mediation fails to resolve the dispute within a further thirty (30) days, either party may commence legal proceedings in the courts of South Australia.

15.4 Nothing in this clause prevents either party from seeking urgent interlocutory or injunctive relief from a court of competent jurisdiction.

16. General Provisions

16.1 Entire Agreement. These Terms, together with the Privacy Policy and any supplementary terms applicable to specific features of the App, constitute the entire agreement between you and RS Digital with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

16.2 Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed and the remaining provisions shall continue in full force and effect.

16.3 Waiver. No failure or delay by RS Digital in exercising any right, power, or privilege under these Terms shall operate as a waiver thereof, nor shall any single or partial exercise preclude any other or further exercise thereof.

16.4 Assignment. You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may assign these Terms in whole or in part to any successor entity or in connection with a merger, acquisition, or sale of substantially all of our assets.

16.5 Force Majeure. RS Digital shall not be liable for any failure or delay in performing its obligations under these Terms to the extent that such failure or delay is caused by circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemic, government action, power failure, internet or telecommunications outage, or third-party service failure.

16.6 No Agency. Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and RS Digital.

16.7 Apple App Store Terms. These Terms are between you and RS Digital only, and not with Apple Inc. (“Apple”). RS Digital, not Apple, is solely responsible for the App and its content. Your use of the App must comply with the Apple App Store Terms of Service. Apple has no obligation to furnish any maintenance or support services with respect to the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the App. Apple is not responsible for addressing any claims by you or any third party relating to the App. Apple is a third-party beneficiary of these Terms and, upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

17. Governing Law

17.1 These Terms shall be governed by and construed in accordance with the laws of the State of South Australia and the Commonwealth of Australia, without regard to conflict of law principles.

17.2 You irrevocably submit to the non-exclusive jurisdiction of the courts exercising jurisdiction in South Australia and all courts competent to hear appeals from those courts.

17.3 The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.
